Lasting Powers of Attorney

Most people now recognise it is important to arrange their affairs and put them in order by making a Will, however far fewer make provisions for someone else to deal with their affairs during their lifetime should they become unable to do so themselves through illness, accident or old age.

Denbert Associates (Fareham) Ltd can produce legal documents called Lasting Power of Attorneys (LPAs) which enables you to appoint people of YOUR choice to look after your affairs should you be unable to do so.

These documents need to be created while you are fit and healthy as arrangements cannot be made once you have lost or are losing capacity.

There are two types of Lasting Power of Attorney which are separate documents enabling you to make either one or both.

A Property and Financial Affairs LPA allows you to appoint one or more Attorneys to handle your property and financial affairs should you be unable to do so yourself through mental or physical ill health.

You can state in the document whether you wish for you LPA to be effective immediately or only if you become mentally or physically incapable of managing your affairs.

A Health and Welfare LPA enables you to appoint Attorneys to make decisions on your behalf regarding what medical treatment you receive, how and where you live and special requirements you have that need to be taken into account.

In either case the document cannot be used until it is registered with the Office of the Public Guardian at the Court of Protection. You and up to five people you nominate have to be notified at that time and can object to the registration of the document.
